Target Audience: 

This activity has been designed to meet the educational needs of nurses, physicians, and other health and legal professionals involved in the care of pediatric victims of sexual assault and domestic violence.

Statement of Need/Program Overview: 

This webinar will discuss the legal issues surrounding adolescent (minor) consent to medical treatment for sexual assault. Also will review medical record privacy and disclosure, parental access to minor records, and consent issues related to pregnancy prevention.

After completing this activity, the participant should be better able to:

  • Describe the legal basis for minor consent to healthcare treatment in general.
  • Describe the legal basis for minor consent for sexual assault identification and treatment.
  • Describe the interplay of HIPAA requirements with minor consent under state law.

Presenter(s): 

Renee H. Martin, JD, RN, MSN

Ms. Martin is a member of the firm of Rhoads & Sinon, a premier mid-Atlantic law firm with its main office in Harrisburg, PA. Ms. Martin exclusively practices health care law and advises both individual and institutional health care providers on regulatory and transactional matters. A significant portion of her practice centers on mental health, and substance abuse law, including HIPAA and fraud and abuse compliance and informational privacy. Ms. Martin has assisted in the formation of Regional Health Information Centers, mental health medical homes working closely with Federally Qualified Health Centers and mental health providers. She has represented numerous providers facing OCR audits and investigations and has brought each to a successful conclusion. Ms. Martin frequently writes and speaks nationally on HIPAA privacy and mental health issues and professional practices issues affecting licensed mental health and substance abuse issues. Ms. Martin received her Diploma in Nursing from Bryn Mawr Hospital in 1977, B.S.N. magna cum laude from Neumann College in 1982, her M.S.N. magna cum laude from Villanova University in 1988, where she was listed in "Who's Who in American Nursing," and her J.D. from Villanova University School of Law in 1994, where she was a member of the Moot Comi Board. As a registered nurse she brings a unique clinical perspective which informs her legal advice to clients. Ms. Martin is admitted to practice law in Pennsylvania and is a Registered Nurse in the Commonwealth of Pennsylvania. She is a member of AHIMA, the American and Pennsylvania Bar Associations. She has written a comprehensive book on the issue of patient safety for the American Bar Association and currently serves on the editorial boards of the journals, Patient Safety and Quality Healthcare Journal, ADVANCE for Nurses and HCPro Briefings on the Joint Commission 2012.
